【破產後可否開公司?】破產對創業有影響嗎？幾時可捲土重來？

破產的後果

近年香港營商環境轉差，不少人生意人財政上出現問題，陷入破產危機，眾所周知破產後生活受到一定程度限制，破產人士需要承擔破產的後果，資產需由交予受託人託管，破產期間收入均需要通知受託人作分配。根據香港公司法，身為未獲解除破產的破產人士，不得擔任何公司董事職務，或直接或間接參與或涉及任何公司的管理，除非獲原訟法庭裁定許可。

解除破產年期

一般而言，如你是首次破產而能遵照《破產條例》的規定和條件，以及法院沒有作出不開始令或債權人和受託人都沒有提出反對，你便會在破產令頒布當日起計算的4年後，自動獲解除破產。如果你再次被判定破產，有關的年期則是5年。

解除破產免除所有債項

獲解除破產後，便可獲免除所有可證債項，但不包括以欺詐方法招致的債項、因觸犯法例而被判處的罰款和導致任何人身體受傷而須作出的賠償等。詳細有關破產的須知可瀏覽破產管理署網頁。

解除破產後開公司

破產人士獲取解除破產令 後可再開有限公司，出任公司董事或參與有關公司管理的工作。

破產後可開公司銀行戶口嗎?

根據過往經驗，一般情況，只要能出示解除破產令證明書，曾經破產的人士都可代表公司開銀行戶口。不過當然最終決定權由個別銀行決定。
